Instrumen Pembahagian Harta Pusaka Islam di Singapura

ABSTARK

Hukum faraid dan wasiat merupakan dua instrumen utama syariah dalam menyelesaikan pembahagian harta pusaka Islam dengan bertujuan menjaga kemaslahatan dan kebajikan ahli waris yang ditinggalkan selepas berlakunya sesuatu kematian. Dengan kehidupan masyarakat Islam yang berubah-ubah,pelbagai isu baru yang dikenalpasti telah memberi kesan kepada bentuk pemilikan harta dan cara dalam menyelesaikan pembahagian harta pusaka orang Islam di Singapura. Hasil daripada itu, para pengkaji masa kini terutamanya di Malaysia telah mengemukakan pelbagai instrumen alternatif sebagai jalan keluar kepada isu-isu yang timbul. Para pengkaji mencadangkan pemilik harta agar membuat perancangan awal bagi menjamin kebajikan ahli warisnya. Berdasarkan kepada instrumen-instrumen yang telah dicadangkan, kajian ini bersesuaian dengan konteks masyarakat Islam di Singapura.

Abstract

Faraid and Wasiyyah law are two main instruments of Shari'ah in dealing with the division of the Muslims estate as to sustain welfare of the beneficiaries upon their death. As the life of Muslim community keeps on changing, some of new issues that exist affect the form of property owner ship and ways in dealing with the distribution of Muslim's estate in Singapore. As the result, current researchers who are mainly in Malaysia, have suggested a few alternative instruments as to solve the issues that arise. Previous studies recommended that the owner needs to plan as to protect the welfare of the beneficiaries. Based on these instruments that have been proposed, this study considers and applies those instruments that suit the context of the Muslim community in Singapore.
