Qiyas Al Shabah dan Aplikasinya dalam Kewangan Islam

Abstract

Rapid development of modern Islamic financial system with the introduction of various financial products and services require Shariah scholars to fully understand the process of deducing the hukum i.e. the Fiqh and its root (Usul al-Fiqh). One of the key concept in the Usul al-Fiqh is Qiyas al-Shabah – analogical process on the basis of attributes from several similar laws (Asal) which comes closest to the case in question (furuc). However, looking at the current practices of deducing hukum in Islamic finance, the connection between Usul al-Fiqh – which includes Qiyas al-Shabah- and Fiqh no longer visible as it is supposed to be. Therefore, this article aims to examine the views of the Islamic jurists on the Qiyas al-Shabah and its application in products, services and instruments of the current Islamic finance.
